- Subscription Agreement
- This Bestie user agreement is between you and MUMSHOP.com (referred to in this agreement as “we”, “us” or “our”) (“User Agreement”).
- By selecting and purchasing your Bestie membership, you are agreeing to an ongoing subscription service to receive the benefits set out in this User Agreement and billed in advance yearly.
- To subscribe to Bestie, you must hold an existing MUMSHOP.com account.
- Subscriptions are limited to a single user and are not transferrable.
- We may refuse any subscription at our discretion. Where we refuse a subscription (at or within a reasonable time after the subscription date), you will be provided with a full refund.
- Bestie is only valid to a maximum of 3 delivery addresses. You cannot change addresses more than once every 6 months.
- Monthly Subscription
- A monthly subscription entitles you to receive full Bestie member benefits set out in clause 3 for one (1) month from the date of your subscription.
- Monthly subscriptions will be automatically renewed unless cancelled by you prior to the renewal date. The renewal date will be the 30 days from the date of your first payment.
- Annual Subscription
- A yearly subscription entitles you to receive full Bestie member benefits set out in clause 3 for one (1) year from the date of your subscription.
- Yearly subscriptions will be automatically renewed unless cancelled by you prior to the renewal date. The renewal date will be the one-year anniversary of your subscription or previous renewal date.
- Bestie Member Benefits
- Being a Bestie entitles you to the following benefits at MUMSHOP.com:
- Bestie Price on all products storewide, where the Bestie Price is guaranteed to be lower than the regular member price,
- Extended access to MUMSHOP exclusive Bestie Deals,
- Priority customer service,
- Free standard delivery on all eligible orders above $35.00.
- Bulky items such as strollers or furniture may incur an additional delivery charge.
- Cancelling Your Subscription
- You can cancel your Bestie subscription or free trial at any time by logging into your account on the desktop or mobile site, going into the Bestie tab of the My Account section and clicking 'Cancel My Subscription'.
- Your cancellation will take effect from the end of your then-current subscription period.
- Modification and Termination and Fair Use
- MUMSHOP reserves the right to:
- Modify or change the benefits of the service at any time,
- Alter any fees charged for Bestie membership. Changes to fees will only take place when your membership renews for another year.
- We will notify you of any changes, and you may cancel your subscription prior to such changes taking place.
- Your continued use of Bestie after notification of any change is made will constitute your acceptance of any such changes. If you do not agree to the changes, you may cancel your subscription either prior to making a purchase with your Bestie membership status or within 14 days, whichever occurs first, by contacting us via email at support@mumshop.com.
- Fair Use Policy and breach: Where we suspect that you are abusing your member benefits by, for example, sharing your account with existing users, placing multiple or excessive single item orders, or otherwise engaging in conduct is an abuse of your member benefits, the free trail (where applicable) or a breach of these terms and conditions, we may cancel your membership. Where we revoke a membership subscription for misuse or breach of these terms and conditions, subscription fees are not refundable.
- We also reserve the right to terminate your subscription at any time, without notice if we choose to stop providing the services. In such circumstances, you will be provided with a partial refund of your subscription fee, calculated by the amount of time remaining before your subscription would have been set to renew.
- Limitation of Liability
- In addition to the limitations, exclusions, indemnities and disclaimers in our standard terms and conditions, to the maximum extent permitted by law (including the New Zealand Consumer Guarantees Act) in no event shall we, or any of our officers, directors, employees, agents or representatives be liable to you or any third party for any loss or damage arising from or connected to your Bestie subscription, including any direct, indirect, special, punitive or consequential damages or losses, or any other costs, losses or damages or any kind related to this agreement. Our liability (whether in tort or contract) is, at a maximum, limited to the subscription fees paid by you for the current or latest subscription period.
- Nothing in this agreement is intended to limit or adversely affect any right which cannot be waived under New Zealand Consumer Guarantees Act.
